A man has appeared in court charged with health and safety breaches that caused death of an 11-year-old East Ardsley boy on a farm.
Gary Green, 51, was driving a tractor at Swithens Farm, Rothwell, in August 2013 when he hit and fatally injured Harry Whitlam.
Andrew Broom, prosecuting, told the court: “This is an alleged breach of health and safety legislation that he did expose employees at the farm to risk by working under the influence of drink.
“It is the crown’s case that exposing the employees to risk led to the death of Harry Whitlam.”
Dressed in a black and yellow hoodie and blue jeans, Green appeared emotionless as he spoke to confirm his name, date of birth and address when he appeared at Leeds Magistrates’ Court, for a short hearing this morning.
Green, of Robin Hood, Wakefield, denies two charges of breaching health and safety regulations.
District Judge Susan Bouch, bailed Green until his next appearance at Leeds Crown Court on May 9.
