Flytippers will be hit with £400 fine

Wakefield Council is clamping down on flytipping in the district by introducing fines of £400.

The council is being asked to approve the recommendation that Fixed Penalty Notices be issued for small scale flytipping.

The fine will be reduced to £300 if it is paid in full within 10 days.

New legislation came into force earlier this year giving council’s new powers to take action against those found to have dumped their waste illegally.

Wakefield Council will be able to issue the Fixed Penalty Notices if approved at its cabinet meeting on December 20.

The council will still look to prosecute for more serious and larger flytipping offences through the courts which can see the offender face a maximum prison sentence of five years and/or an unlimited fine.

If Fixed Penalty Notices are not paid, the council will then prosecute the offender.

Coun Maureen Cummings, Cabinet Member for Environment and Communities, said: “Flytipping is a serious criminal offence and it will not be tolerated in our district.

“It costs the council more than £150,000 every year and issuing Fixed Penalty Notices for smaller scale offences will help to save the council time and money in prosecuting through the courts.

“Introducing Fixed Penalty Notices we also mean we can take immediate action against the perpetrators.”
