AN ice cream man who has worked at Hemsworth Water Park for around 20 years claims he has been unfairly banned from the site over one cup of coffee.

Rob Barlow, 48, is appealing the decision by Hemsworth Town Council to terminate his contract to sell ice creams from his Uncle Les vans at the park.

He has been told he is no longer permitted to operate there as his company has breached the terms of the contract.

Mr Barlow claims the council believe he has been selling hot drinks from his ice cream vans - which would be a breach of the contract.

But the father-of-three from Grimethorpe said this happened on just one occasion due to a mistake by a member of his staff.

He believes the termination of his contract was an unjustified move to make way for a Walls ice cream stand at the Lakeside Cafe.

Mr Barlow said: “This is something I could do without at the moment but the council have no compassion at all.

“They’ve terminated my contract, despite the fact I’ve paid them, and they won’t listen to reason.

“The lad that works for me gave away a coffee on one occasion when the cafe shop wasn’t even open. But as a rule we never sell hot drinks down there, and the council don’t have any evidence that we do - they said I was seen selling drinks on a certain date when I didn’t even have the van down there that day.

“I feel like they’ve totally stitched me up and gone behind my back to get rid of me and make way for Walls.”

But a statement from the town council said: “There is, and always has been, a clause in the terms and conditions of the tender that allows the town council to sell ice cream from the Lakeside Cafe, Windys and the Playworld kiosk.

“The council are selling Walls ice cream from two of these outlets but not from the sites in the Water Park allocated for ice cream vans.”

Mr Barlow is appealing the decision to terminate his contract with the backing of independent town councillor Jim Kenyan.
